The Department administers a grants program on behalf of the Attorney General, drawing on funds collected under the Criminal Property Confiscation Act 2000. Criminal money and property is seized by the Western Australian Police and the Office of the Director of Public Prosecutions. After some costs are met for these authorities, funding is available for a Community Grants Program.
The Criminal Property Confiscation Act 2000 provides for the confiscation in certain circumstances of property acquired as a result of criminal activity or used for criminal activity. The Act also makes provision for re-distribution of confiscated funds and proceeds of the disposal of other confiscated property for a range of purposes including those detailed below.

Round 13 of the Grants Program closed on 16 December 2015. Forty-eight applications seeking a total of over $7.7 million were received.
